Navigating New Real Estate Forms: Key Buyer and Seller Questions Answered in the Bay Area Market

Today, I want to address some of the most frequently asked questions I’ve been hearing from both buyers and sellers in our current market. With the new forms rolled out on August 17th, there are a few important implications to consider.


Do Buyers Pay Their Agent?


One of the common questions I get from buyers is whether they need to pay their agent's compensation. My answer? Maybe, but most likely no. In many cases, the seller’s agent covers this cost, making it easier for buyers to navigate the process without additional financial burdens.


Do Sellers Pay the Buyer’s Agent?


Conversely, sellers often ask if they need to pay the buyer’s agent. My response here is also maybe, but most likely yes. In the Bay Area's unique and stable market, which has shown consistent appreciation over the years, this practice is generally the norm.


Understanding the Market Dynamics


The Bay Area market is unlike any other; it has a well-established structure that doesn’t change overnight just because of new forms or fields. When a buyer submits a strong offer that outshines others, sellers are encouraged to consider which offer will net them the most—this may include compensating the buyer's agent.


For buyers, the focus should be on crafting a winning offer that reassures the seller, making them comfortable with the idea of compensating their agent. There are ways to document these arrangements legally and transparently, which I cover in my consultations with clients.
